Legislative Drivers


Federal and State governments have shown support for legislation requiring compliance with renewable energy standards and alternative fuel requirements. Some of the core legislation drivers include:


American Recovery and Reinvestment Act of 2009 (ARRA 2009)
Signed into law by President Obama on February 17th, 2009, this act is an unprecedented effort to jumpstart our economy, create or save millions of jobs, and put a down payment on addressing long-neglected challenges so our country can thrive in the 21st century. The ARRA authorized $16.796 billion dollars to energy efficiency and renewable energy, including $470,716,874 in total energy efficiency and renewable energy to the State of Florida alone. The ARRA shows The Department of Energy's commitment to reducing America's dependence on foreign oil and developing energy efficient technologies for buildings, homes, transportation, power systems and industry.


Energy Independence and Security Act of 2007
Enacted on December 19, 2007, this act increased the renewable fuels standard to mandate fuel producers to use at least 36 billion gallons of biofuel in 2022, an approximate five-fold increase over current levels. While 15 billion gallons of this standard are earmarked for corn-derived ethanol, volumes designated for "biomass-based" diesel shall not be less than one billion gallons in 2012 and beyond.


The Energy Policy Act of 2005 (EPACT 2005)
This act established a national renewable fuels standard ("RFS") mandating a minimum usage requirement for renewable fuels. The RFS is expected to stimulate the production of biodiesel fuel as a result of the EPACT 2005's extension of the volumetric excise tax credit for biodiesel of eighty cents per gallon, as well as its mandate that all federal, state, and local governments with diesel powered equipment fleets use a 2% biodiesel blend.
